When we recommend personal advice

Our online service is designed for straightforward Wills and Lasting Powers of Attorney. We may recommend that you obtain tailored legal advice from a regulated firm where, for example, there are:

  • concerns about mental capacity or pressure from another person;
  • substantial business or overseas assets;
  • complicated family relationships or a potential dispute;
  • Property Protection Trusts or complex inheritance arrangements;
  • difficulties identifying a suitable certificate provider for your LPAs; or
  • instructions that cannot be dealt with safely through the standard questionnaire.

Our questionnaire is designed to identify these issues. Where appropriate we will contact you before proceeding, and we may recommend that you take tailored legal advice from a regulated firm before your documents are completed. There is no charge whatsoever for an initial discussion about the services.

Is every document checked before I receive it?

Yes. A check by an experienced legal professional is included in the price of every document, and your document will not be issued until that check has been completed. We check for consistency, completeness and any apparent errors or contradictions, based on the information you provide. The check confirms that your document reflects your answers and has been correctly prepared — it is not bespoke legal advice on your circumstances.

Can I give my instructions over the telephone instead of online?

Yes. Some people would rather talk than type, and that is entirely fine. Call us on 0800 246 1961 and we will take you through exactly the same questions over the telephone, entering your answers as we go. Your document is prepared and checked in exactly the same way, and the price is exactly the same either way.

Is my Will legally valid?

Your completed Will must be signed and witnessed correctly before it becomes legally valid. We provide detailed instructions explaining what you and your witnesses must do.

What is a Lasting Power of Attorney?

It is a legal document that lets you appoint people you trust (your attorneys) to make decisions on your behalf if you become unable to. There are two types: one for property and finances, one for health and welfare.

When can an LPA be used?

An LPA must be signed correctly and registered with the Office of the Public Guardian before it can be used. A Health and Welfare LPA can only be used when you are unable to make the relevant decision yourself. A Property and Financial Affairs LPA may, if you choose, be used with your permission while you still have mental capacity, once it has been registered.

Is the Office of the Public Guardian fee included?

No. The government registration fee is separate from our document preparation fee — it is currently £92 for each LPA, and it is clearly shown before you purchase. Some people may qualify for a reduction or exemption.

How long will it take?

Most customers complete the questionnaire in around 15 minutes, although there is no need to rush — you can save and come back. Once we have received all the information required, most straightforward documents are reviewed and sent within 24 hours. Registration of an LPA by the Office of the Public Guardian takes considerably longer: it currently advises allowing approximately 8 to 10 weeks where there are no errors — we guide you through it.

What happens if my circumstances are complicated?

We will not simply allow you to proceed with a standard document where your answers indicate that more individual consideration may be required — we want your documents to reflect your wishes accurately. We will contact you, explain the concern and discuss the appropriate next step.
